“The Double Helix of Modern Prosperity”
Financial Times Op-Ed: “Argentina invites AI to free itself” (June 5, 2026)
Argentina President Javier Milei argues directly in an editorial today that AI is the next great productivity leap after the Industrial Revolution — one that will free humanity from the constraints of the human brain just as machines freed us from the limits of muscle.
For this to happen, AI needs the right legal architecture: limited-liability corporate entities that can operate autonomously (“non-human corporations”).
Argentina is proactively creating this framework and inviting the world to use it.
Milei opens with the founding of the Dutch East India Company in 1602,
which introduced the modern limited-liability corporation.
This single legal innovation unlocked large-scale capital deployment by capping investors’ risk.
Without it, modern capitalism could not have developed.
He notes that critics at the time warned it would let the wealthy gamble with limited downside — a debate now resurfacing with AI.
Existing legal forms are inadequate for autonomous systems.
Milei cites a Sarcuni v. bZx DAO that treated a blockchain-based decentralized autonomous organization as a general partnership,
stripping participants of limited liability.
He calls this “precisely the wrong legal architecture” for the AI era.
Argentina’s Proposed Solution:
Three Pillars
1 Regulatory Freedom — Keep AI largely unregulated so it can develop without the “deadly hand of premature and poorly understood regulation.”
2 New Corporate Form: The “Non-Human Corporation” — A new legal entity in Argentine law operated by AI agents or robots.
◦ These systems exercise independent judgment in unpredictable environments (a requirement for real usefulness).
◦ Limited liability is essential, not optional — it is a precondition for their existence.
◦ Human shareholders may participate but are not required.
3 Competitive Fiscal & Governance Environment — Low corporate tax rates, freedom for shareholders to choose the corporate governance law they prefer, and strong terms for legitimate business.
Final beneficial owners must be disclosed.
“The machine and the legal entity are, together, the double helix of modern prosperity.”
What do I think? He is really onto something.
Law is at the center of AI.
